We take your privacy seriously, but we don't think a Privacy Policy needs to be completely indecipherable.

This page explains what personal information Betsy Benn Limited collects, why we need it, what we do with it, who we may share it with and the rights you have over your information.

If anything here isn't clear, please ask us. We would much rather answer a question than leave you wondering what happens to your information.

• send us photographs, artwork, drawings or other material for personalisation;

• buy a Betsy Benn product through a third-party marketplace where your information is passed to us so that we can make and fulfil your order.

Third-party marketplaces such as Etsy or Not On The High Street will also have their own privacy policies explaining how they use the information they collect from you.

The information we collect depends on how you interact with us.

Personalisation information

This may include names, dates, locations, addresses, postcodes, map locations, coordinates, wording, photographs, drawings, handwriting, artwork and other information you supply for us to create your personalised product.

Photographs and images may contain identifiable people, including children.

Payment information

Payments are processed using specialist payment providers.

We do not generally receive or store your complete credit or debit card number. We may receive limited information relating to your payment, such as confirmation that payment has been made, the payment method used, transaction references or limited card details such as the final digits.

Communications

We may retain emails, messages, telephone notes and other correspondence between you and us where this is necessary to deal with an enquiry, fulfil your order or provide customer service.

Marketing information

If you subscribe to our marketing, we may hold your email address together with information about your marketing preferences, subscriptions and interactions with our emails.

Website and technical information

When you use our website, we may receive technical information such as your IP address, browser, device type, operating system, pages viewed, referring website and information about how you interact with our site.

Competition and promotional information

If you enter a competition, giveaway or promotion, we may collect the information necessary to administer it and contact the winner.

For example, if you order a Betsy Benn product through a marketplace, the marketplace may provide us with your name, order details, personalisation information and delivery address so that we can make and fulfil your order.

Payment providers provide us with information confirming whether a payment has been successfully processed.

Delivery companies may provide tracking and delivery information relating to your order.

  1. WHY WE USE YOUR INFORMATION

Data protection law requires us to have a lawful reason, known as a lawful basis, for using personal information.

Different lawful bases apply to different things we do.

Fulfilling your order

We use your name, contact details, delivery information, order details and personalisation information to make, personalise, package and deliver your order.

Our lawful basis is normally that this processing is necessary to perform our contract with you.

The same applies where we use a photograph, drawing or other material you have supplied in order to create your personalised product.

Answering enquiries and providing customer service

We use your information to answer questions, deal with changes to orders, resolve problems, process returns and refunds and provide customer service.

Depending on the circumstances, our lawful basis is performance of our contract with you or our legitimate interest in providing good customer service and properly managing our business.

Keeping financial and business records

We are required to retain certain transaction, accounting and tax information.

Our lawful basis for doing so is compliance with our legal obligations.

Preventing fraud and keeping our systems secure

We may use information to detect suspicious transactions, prevent fraud, protect our website and systems and investigate security problems.

Legal claims and protecting our rights

We may retain and use information where reasonably necessary to establish, exercise or defend legal claims, deal with disputes or protect our rights.

Our lawful basis is normally our legitimate interests or compliance with a legal obligation.

  1. PERSONALISED PRODUCTS, PHOTOGRAPHS AND ARTWORK

Many Betsy Benn products are created using information supplied by our customers.

This can include names, dates, addresses, locations, photographs, children's drawings, handwriting and other personal material.

We use this information only as reasonably necessary to create your product, communicate with you about it, fulfil your order and provide related customer service.

If you provide us with a photograph or other material containing somebody else's personal information, you should make sure you have permission or are otherwise entitled to provide it to us for this purpose.

This is particularly important where photographs contain children.

A photograph may incidentally reveal information that could be considered sensitive, for example information relating to someone's health, ethnicity or religious beliefs. We do not use customer photographs to analyse, identify, profile or make assumptions about those characteristics.

Please do not send us personal or sensitive information that we do not need in order to create your product.

  1. HOW WE USE AI

Some Betsy Benn products may involve artificial intelligence or other digital processing tools as part of the design process.

For example, we may use AI-assisted technology to:

• improve the quality or resolution of a photograph;
• clean up or restore an image;
• remove, replace or adapt elements within an image;
• turn a photograph or drawing into another style of artwork;
• create elements of a design based on material you have supplied; or
• adapt customer-supplied material to create the product you ordered.

Where we use AI in this way, it is a production tool rather than an automated decision-making system.

The purpose is to create the personalised product or digital product you have asked us to provide.

Our lawful basis for processing personal information in this way is normally that it is necessary to perform our contract with you.

Google Gemini

For some AI-assisted processing we use Google Gemini.

Our Gemini environment is configured to use data centres within the European Union and so that information and images we submit are not used to train AI models.

We only submit information that is reasonably necessary to complete the relevant production task.

We do not knowingly allow photographs, artwork or other customer information submitted through our configured Gemini service to be used to train general-purpose AI models.

AI and automated decisions

We do not use AI to make automated decisions about customers that produce legal or similarly significant effects.

We do not use customer photographs to identify people, create biometric profiles, infer sensitive characteristics or make decisions about them.

  1. WHO WE SHARE INFORMATION WITH

We do not sell your personal information.

We do not provide your information to other businesses so that they can independently market their own products or services to you.

We do, however, work with carefully selected suppliers and service providers who need limited access to information in order to help us operate Betsy Benn and fulfil orders.

These may include:

Ecommerce providers

Our online store is hosted using Shopify. Shopify provides the ecommerce technology that allows us to operate our website, process orders and manage customer information.

Payment providers

Payment providers process payments securely on our behalf.

Delivery companies

We provide names, delivery addresses and other necessary delivery information to Royal Mail, couriers and other delivery companies used to deliver orders.

Production and fulfilment partners

Occasionally we may use carefully chosen specialist suppliers or production partners to help produce or fulfil particular products.

They receive only the information reasonably required to provide that service.

Cloud storage and technology providers

We use cloud-based systems to store and manage business information, production files and artwork. This may include services such as Dropbox.

AI and image-processing providers

Where appropriate to fulfil an order, limited customer-supplied content may be processed using specialist image or AI services, including our configured Google Gemini service as explained above.

Email and marketing providers

We may use specialist email platforms to manage our mailing list and send marketing communications.

Analytics and advertising providers

Subject to your cookie choices and applicable law, we may use analytics or advertising services to understand website performance and measure our advertising.

Professional advisers

Where necessary, information may be shared with accountants, insurers, legal advisers or other professional advisers.

Government bodies, regulators and law enforcement

We may disclose information where required by law, court order, regulatory requirement or another legally valid request.

  1. INTERNATIONAL DATA TRANSFERS

Some of the companies that provide technology and other services to us operate internationally.

This means that personal information may sometimes be processed outside the United Kingdom.

Where personal information is transferred internationally, we take reasonable steps to ensure that an appropriate legal safeguard is in place.

Depending on the country and provider, this may include:

• UK adequacy regulations;
• the UK Extension to the EU-US Data Privacy Framework where applicable;
• approved contractual safeguards such as the UK's International Data Transfer Agreement or UK Addendum; or
• another transfer mechanism permitted under UK data protection law.

As explained above, our Google Gemini environment used for customer AI processing is configured to use data centres within the European Union and not to use our submitted data for model training.

  1. COOKIES AND SIMILAR TECHNOLOGY

Our website uses cookies and similar technologies.

Some cookies are necessary for the website to operate. For example, they may enable the shopping basket, checkout, security or other essential website functionality.

Other technologies may help us understand how visitors use our website, remember preferences, measure advertising or improve our services.

Where UK law requires us to obtain your consent before using a cookie or similar technology, we will do so.

Certain essential or otherwise legally exempt technologies may be used without consent where permitted by law.

  1. MARKETING EMAILS

We would like to tell you about new Betsy Benn products, offers, ideas and other things we think you might genuinely be interested in.

We may send electronic marketing where:

• you have specifically asked or consented to receive it; or
• UK law allows us to contact an existing customer about our own similar products and services under what is commonly known as the "soft opt-in".

Where we rely on the soft opt-in, it will only be where the legal conditions are satisfied, including giving you an appropriate opportunity to opt out when your information is collected and in every subsequent marketing message.

You can unsubscribe at any time by using the unsubscribe link in our marketing emails or by contacting us at betsy@betsybenn.co.uk.

Unsubscribing from marketing will not stop essential emails about an order you have placed, such as order confirmations, dispatch notifications or messages needed to resolve a problem with your order.

We do not sell mailing lists or provide your details to unrelated companies for their own marketing.

  1. HOW LONG WE KEEP YOUR INFORMATION

We do not keep personal information indefinitely simply because we have collected it.

Different types of information are needed for different lengths of time.

Order, accounting and tax records

We normally keep relevant order, invoice, payment and accounting records for at least six years where required for tax, accounting and legal purposes.

Some records may need to be kept for longer where a particular tax scheme or other legal obligation requires it.

Customer service and order correspondence

Correspondence relating to an order may be retained with the order record where reasonably necessary to deal with queries, complaints, disputes or legal claims.

Personalisation files, photographs and artwork

Customer-supplied photographs, artwork and production files are kept only for as long as reasonably necessary for purposes such as:

• creating and fulfilling the order;
• checking production quality;
• dealing with customer service queries;
• producing a replacement where needed;
• enabling a requested reorder where appropriate; or
• dealing with a dispute or legal issue.

We periodically review production material and delete files that we no longer reasonably need.

Some information may remain temporarily in secure backups after deletion from our active systems until those backups are routinely overwritten or deleted.

Marketing information

If you subscribe to our mailing list, we may retain your details while you remain subscribed.

If you unsubscribe, we may retain limited information on a suppression list so that we know not to send you marketing again.

This is preferable to deleting all record of your request and accidentally adding you back to the list later.

  1. HOW WE PROTECT YOUR INFORMATION

We take reasonable technical and organisational measures to protect personal information against unauthorised access, loss, misuse, alteration or disclosure.

These measures include appropriate access controls, password protection, secure cloud services, encryption where appropriate and limiting access to customer information to people who need it for their work.

Our staff and contractors are expected to respect the confidentiality of customer information.

No internet or storage system can be guaranteed to be completely secure, but we take information security seriously and review the systems and services we use.

You always have the right to object to your personal information being used for direct marketing.

The right to withdraw consent

Where we rely on your consent, you can withdraw that consent at any time.

Withdrawing consent does not make processing that took place before withdrawal unlawful.

Rights relating to automated decision-making

You have rights relating to certain types of solely automated decisions and profiling.

Betsy Benn does not currently use personal information to make solely automated decisions about customers that have legal or similarly significant effects.

There is normally no charge for exercising your data protection rights.

We may need to ask for information to confirm your identity before dealing with a request.

We will respond to valid rights requests within the time required by data protection law, normally within one calendar month.

If you are concerned about how we have collected, used, stored, shared or otherwise handled your personal information, you have the right to make a data protection complaint to us.

Please make it clear that your message is a data protection or privacy complaint and give us enough information to understand what has happened and what you would like us to look into.

We will acknowledge a data protection complaint within 30 days of receiving it.

We will take appropriate steps to investigate the complaint without undue delay, keep you informed where appropriate and let you know the outcome of our investigation.

You also have the right to complain to the Information Commissioner's Office.

You do not have to complain to us before approaching the ICO, although we would always welcome the opportunity to try to resolve your concern.
